Summary:
The present thesis attempts to address and approach as thoroughly as possible the main issues related to the Laytime and Demurrage clauses, which are traditionally incorporated in voyage charters. The peculiarity of voyage charters is found in the fact that the risk of delays varies according to the stage of execution of the contract, unlike time charters, where time is fully fixed at the expense of the charterer. Therefore, in voyage charters, the time spent for the fulfillment of the parties' obligations is an essential element, as it is directly linked to their liability for delays in the conduct of the maritime operation. The major importance of the laytime and demurrage regime in voyage charters is highlighted by the fact that the interests of the parties are inversely related at the stages of the ship's immobility. While the shipowner seeks the shortest possible release of his ship from the loading and unloading process, the charterer seeks a longer period of time to carry out these operations, as this ensures more comfort and he is able to cope with any unforeseen circumstances, as well. These conflicting interests are largely regulated by the laytime and demurrage regime. Laytime and demurrage present variations in terms of their commencement, nature and duration, and their contractual configurations, issues that will be subject to a more detailed study and comparison in this Thesis.
