Summary:
This study is divided into two parts. In Part A, the main, at european level, institutional text concerning the return process is analyzed, which is the Directive 2008/115/EC of the European Parliament and of the Council of December 16, 2008. The study of the Directive is carried out in parallel with the study of its integration into the greek legal order and finally is following a brief presentation of its reformulation proposal by the European Commission, as well as the proposal of the new Pact on Migration and Asylum, which if activated, will also have major impact on the return process. In Part B, the crusial role of human rights in the return process is highlighted through extensive references to jurisprudence and the contribution of Frontex and the Ombudsman during the implementation of the return process is described.
