Summary:
Traditional settlements in relation to other cultural assets present an element of uniqueness, being at the same time in a strong relationship with both the past and the present. Indeed, their relationship with the present is dynamic, as people still live and work in them today. This dual dependence entails two equally important obligations: the need to preserve their traditional character in perpetuity and the need to integrate them functionally and effectively into the present as it evolves and develops. Perhaps the greatest challenge of modern times is climate change, to which traditional settlements must also adapt, without, of course, losing their value or their traditional character. This thesis attempts to outline the concept of traditional settlements and the existing framework for their protection, to list the weaknesses observed in this framework and to attempt to formulate legal proposals at a general level.
