Summary:
The present thesis examines the operation of the open – current-account in the context of credit agreements, focusing on the relations between contracting parties and towards third parties. In particular, it examines the most important issues that have occupied case law and theory over time and attempts to categorise them according to the founding of their resolution. The first category includes (a) the after-the-closure-of-the-current-account question of liability by a general partner (fully liable member) having left the partnership during the operation of the current-account, (b) the question of seizure admissibility in the current-account and (c) the question of fraudulent expropriation during the operation of the current-account. The second category is devoted to the question of the status of any collateral provided in favour of individual claims entering the current-account and in favour of the balance after its closure. Finally, the third category of issues relates to the termination of the credit agreement on behalf of the credit institution and the subsequent final closure of the current-account. For each of the above issues, the positions that have been supported in theory and case law are exhaustively presented. Critical comments on them are also provided, based on a careful analysis of the minor premise of the judgments, on the identification of the conflicting interests in each case, on the disclosure of the criterion of weighing those interests up by the case law and on the verification of the compatibility of this criterion with the fundamental principles that are recognised as governing the current-account. In the final chapter, the author's proposal is set out for a new evaluative approach of the operation of the current-account, based on the development of a thorough practical counter-proposal comprising new balancing criteria of the relevant conflicting interests.
