This doctoral thesis is placed at the intersection of constitutional law, free competition law and EU law.In particular, in the context of this doctoral thesis, an attempt will be made to examine, paraphrasing the thinking of the famous decision of the Supreme Court Parker vs. Brown, not only "if there is something in the law of free competition and its history that indicates that state action also falls within its scope", but mainly if a general principle of the protection of free competition is established at the constitutional level in the Greek legal order which binds state action in all its forms, i.e. both in its contractual and unilateral forms
