The appellate review of proof in the light of jurisprudence of the European Court of Human Rights
Summary:
The present Thesis analyses the issue of appellate review of proof in the light of jurisprudence of the European Court of Human Rights. Specifically, attempts a comprehensive reference to the grounds of appeal arising from deficiencies or defects in criminal decisions.
In particular, the conceptual content of the evidence, the degree of proof of guilt, the judicial and investigating authorities’ obligation to seek the substantive truth ex officio with its legitimate limitations, the court’s obligation for a rational evaluation of the evidential material in relation to the true meaning of the principle of moral evidence as well as the link between reasoning and evidence are presented. The content of the appropriate reasoning is determined, which is an inherent element and component of the concept of a fair trial and is inextricably linked to the proper administration of justice, as perceived by the ECHR and must be present in any criminal decision. Subsequently, reference is made to the relation between the reasoning of the criminal decision and the presumption of innocence of the accused, and at the same time a critical overview of the Supreme Court’s jurisprudence in conjunction with the provisions in the ECHR’s jurisprudence.
Lastly, are examined, the criteria that must be taken into account for the acceptance or rejection of the accused’s request for conduct evidence, the ECHR’s position on the evaluation and assessment of the evidence (such as, for example, in the cases of absent prosecution witnesses) as well as the objective-empirical criteria of the rules of logic, the common knowledge notorious facts and the safe science diagnoses, the review of the appropriate application of which, should be carried out by the Supreme Court in the context of the logical audit of the evidential reasoning.
