Summary:
The thesis deals with the interaction between human rights and the environment which has been combined and expressed through the protection of procedural rights for the protection of the environment in the text of the Aarhus Convention. Initially, the right to the environment is studied as an essential right in the light of human rights and the contribution of the enshrined human rights to the protection of the environment. In this context, the right to a healthy environment is examined as it is interpreted and protected through the European Convention on Human Rights (ECHR) and the jurisprudence of the European Court of Human Rights (ECtHR) alongside the protection provided by procedural rights, which are guaranteed from the Aarhus Convention. The second and main part of the study is devoted exclusively to the analysis of the Aarhus Convention, which has been characterized as a driving force for environmental democracy in all its three pillars: access to environmental information, public participation in decision-making and access to justice on environmental issues. The basis of the study is the jurisprudence of the ECtHR, the Court of Justice of the European Union, the Aarhus Convention Compliance Committee and of course the jurisprudence of the Greek courts, mainly the Council of State, as well as the reports and findings of the Greek Ombudsman.
