Summary:
As a society approaches the point where the environment, due to its rapid degradation, begins to change its status from a consumable resource to a valuable good, the moral transformation of the environment follows. This forces us to think about the fair use and appreciation of this scarce resource. This paper explores the possibility and means by which we can establish the moral obligation of individuals towards the environment, as well as the right to protect the environment. The extent of the moral status of the environment and the importance of its intrinsic value, along with the subsequent decision between the two, not only shapes our understanding of moral behavior, but also influences our understanding of environmental issues.
In addition, the research examines the unfair distribution of environmental goods and burdens caused by the climate crisis, highlighting the importance of environmental justice. The burning of fossil fuels for energy production is recognised as a major contributor to the climate crisis, highlighting the need for energy justice in terms of both consumption and accessibility.
In this context, this paper presents regulatory efforts that combine both the environmental ethics and environmental law, particularly within the European Union, to formulate relevant policies towards a just energy transition and attempts to examine how the tools offered by the long tradition of ethical philosophy can redefine the terms of public debate and regulatory effort. By adopting an ethical perspective that recognizes the importance of obligations, we can develop precautionary approaches and policies that prioritize the well-being of all.
