The conractualization of public law

In the modern era that we are going through, a change is observed in the way of action of the public administration. The State, no longer able to cope adequately with the ever-increasing demands that are constantly being created, is looking for new ways of organization and action, through which it will be able to fulfill the obligations it has undertaken towards its citizens. Characteristic of this is the shift or in other words the mutation of the mode of governance that we knew until now between the State and the governed. This phenomenon is known by the term "contractualization of public law".This consists in the conversion of the way public administration is exercised, that is, the transition from a law -based governance, towards a contract based governance and primarily on relationships based on consensus, bonds of faith and the interdependence of administration.
