Summary:
The present thesis is an attempt to examine animals as legal persons as comprehensively as possible, whether or not they are given personality, including the current legal situation ("de lege lata"), and approaching it with a critical eye in combination with a social focus. To make this possible, the analysis starts from the general principles of law and what is defined as a 'person', framing any definition by the ethical/philosophical foundations that dictate the elevation or not of animals as subjects of law, under the umbrella of idiosyncrasy, and its abolition for social justice.
The research will not only focus on Greek law, but will also approach definitions and regulations of the issue of the treatment of animals at European and international level, while it will also try to highlight the respective legal regulations in relation to the traditions and culture of the respective societies. In this context, I hope to highlight the point in time at which the legislator chooses to regulate, i.e. whether society first imposes the regulation and he or she follows, or whether he or she first regulates before being asked to do so. By exploring the intersection of ethics, philosophy, law and speciesism, the research aims to provide a nuanced understanding of the complexity inherent in the recognition of animals as subjects of law, but also of the contradictions in which the legislator himself.
