Protecting third-country nationals’ family life under the ECHR
Summary:
In the light of the European Convention on Human Rights, this paper examines the protection of third-country nationals’ family life, in case family members do not enjoy independently the right of entry or residence in a state member of the ECHR. Τhe first part of the paper describes the concept of the respect for the family life of foreigners and the concept of family reunification, as registered in international texts, the European legal order, the Constitution and our national legislation. In the second part, it is attempted to define the concept of "family life", through the analysis of characteristic decisions of the ECtHR, concerning foreigners. In order to clarify whether an intervention in the right to family life can be justified, the conditions of the second paragraph of Article 8 of the ECHR are analyzed, citing decisions of the ECtHR. Consequently, the principles on the basis of which the necessity of the measure that constitutes interference with the right to respect for family life are described (criteria of the Boultif and Üner judgments). These principles must govern the action of the national authorities and its control by the national courts. The third part of this paper refers to the Greek legal order, including the analysis of the decisions Kolonja v. Greece and B.A.C. against Greece. Then, an attempt is made to capture the extent of the application of article 8 par. 2 ECHR by the Council of State, through the citation of decisions that mainly concern deportation cases. The paper concludes with observations regarding the protection of the right to respect third country nationals’ family life, according to Article 8 ECHR, in the light of ECtHR jurisprudence, but also in the context of the Greek legal order.
