Summary:
The subject of the dissertation is the study of the position and functional role held by the principle of equal treatment in the institutional environment of public contracts. As one of the basic general principles of public contract law, the principle of equal treatment impacts all stages prior to the signing of the contract and also simultaneously influences the execution stage. The dissertation focuses on the characteristic of the principle to systematically generate rules and obligations during its application in the context of public contracts. Through critical analysis of crucial EU provisions and a significant part of the case law of the Court of Justice of the European Union extending from historic decisions such as Storebaelt and Teleaustria, to the most recent decisions of the Court, the dissertation , on one hand, describes the historical development of the foundation of the principle of equal treatment in public procurement law, and on the other hand, examines its contemporary application and function.
