Marriage contracts and divorces in the papyri of Roman and late Egypt
Summary:
This paper examines marriage contracts and divorce documents from Roman Egypt and Late Antiquity Egypt. It considers the complex legal system in which the Greek, Egyptian and Roman legal systems coexisted, influenced each other and affected marriage and divorce practices. It examines how these different legal systems shaped the structure and content of marriage contracts and divorce documents. The different types of marriage contracts are analyzed, with representative examples such as agraphos - engraphos gamos, syngraphe sykikisiou, syngraphe trophitis, synchoresis and divorce documents. Emphasis is placed on the evolution of these documents over time and the interaction between legal traditions. In addition, family law and the legal regime relating to childcare in the context of marriage and divorce are examined. A brief comparison is provided with similar documents (marriage contracts and divorces) from the Byzantine period. Finally, main concepts such as dowry, inheritance and the rights of spouses, including the possibility of remarriage, are explored.
