The importance of harmfulness and culpability in sentencing
Summary:
The aim of the present dissertation is the analysis of the normative principles in sentencing (article 79 of greek Penal Code). In the first part of the thesis, the essence of the senctencing is examined. In particular, the thesis analyzes the way in which the harmfulness of the conduct and the culpability of the actor are assessed in the formation of the sentencing purview as well as in the imposition of a penalty of a certain type and amount. The object of the study will be particularly the cases of reduced harmfulness and respectively the cases of reduced culpability and their evaluation in sentencing. In the same section, the content of the sentencing circumstances contained in article 79 of the Penal Code, as amended in 2019, will be analyzed. The second part of the thesis examines the methodology of the sentencing process. It is deemed necessary to start the research from the theories of punishment, in order to then approach the basic positions of the main sentencing theories that have been developed in the German and Anglo-Saxon jurisdictions, as well as the criticism that has been leveled at each of them. Next, the five-phase model is analyzed, which can be set as the basis of a systematic sentencing procedure. Particular emphasis is also placed on some more specific aspects of the sentencing process: the way of assessing the sentencing circumstances, the prohibition of double assessment and the problem of finding a comparison measure as a starting point for determining the sentence to be imposed. The third part examines the procedural aspects of sentencing. There are two main issues of interest in this part. The first one is the obligation of the judge to justify the sentencing verdict. The second one is the problem of admissibility of legal review of the court's judgment by the greek Supreme Court.
