The protection of the accused between secular and ecclesiastical criminal law
Summary:
The rights of the accused in ecclesiastical court do not arise from the Convention on Human Rights. These are already founded and protected in the sacred canons, which apply the Christian spirit and the view of man as a person created in the image of God. The administration of Ecclesiastical Justice is done by similar legal remedies to those of Common Criminal Justice, but the sentences it imposes have a different spirit, they are not punitive, but mainly therapeutic. Ecclesiastical law mainly protects spiritual property, since all transgressions and offenses entail deprivation from the sacrament of the Holy Eucharist, which is why a series of practices of repentance are provided for the reintegration of the offender into the sacramental life of the Church.
