General average and marine insurance

The present study examines the views and practices of shipping companies in Greece regarding General Average and marine insurance. The aim of the research was to investigate the procedures for managing general average incidents, the companies' relationships with insurers, and the challenges that arise in the allocation of losses. In addition, the study focused on the adequacy of the existing legal framework and international conventions and rules, such as the York-Antwerp Rules. The research was based on a quantitative methodology, using a questionnaire completed from executives who are working in legal departments dealing with general average issues from seven (7) Greek shipping companies with large fleets. Data analysis was carried out using descriptive statistics, highlighting the views of the participants. The results showed that common aversion is considered to be extremely important, with the majority of companies having experience of managing related incidents. However, challenges in the loss allocation process were identified, including a lack of transparency and disagreements between the parties involved. The role of the insurers was described as mainly advisory, with the greatest difficulties being found in the claims assessment phase. At the same time, the survey showed that the existing legislation is considered adequate, with the majority of participants not considering a revision of the York-Antwerp Rules to be necessary. However, simplification of procedures was a key request for improving the legal framework.
