Summary:
Τhe main axis of the dissertation is developed around the question of whether the current, well-established models of jurisdiction suffice to secure the effective protection of human rights. Simultaneously, it investigates whether a functional model, based on the special relationship formed between the individuals and state, could correspond more adequately to the contemporary challenges and to the different types of cases brought before the ECtHR.
Adducing some of the significant -and quite often contested- cases of the ECtHR, the survey tries to indicate the inconsistencies and legal uncertainties that have been generated by the Court’s jurisprudence throughout the years. Building on this premise, it reassesses some of the cases, via the filter of the functional model proposed, so as to illustrate its contribution to a more solid and coherent framework.
