Summary:
The purpose of this thesis is to identify the legal challenges surrounding the parental responsibility under the articles of the European Convention on Human Rights as interpreted through the jurisprudence of the European Court of Human Rights, giving an emphasis on Article 8 which is deemed to be of utmost importance when dealing with cases of parental responsibility. It also stresses the significance of the "Best Interest of the child", which is a primary notion in cases concerning children. Furthermore, it examines the holders of parental responsibility taking into consideration the increasing commonality of cohabitation-based relationships without marriage and the legal challenges arising in case of unmarried fathers and same sex partners. Last but not least, a comparison is made between the ECHR and other relative Conventions. At last, landmark cases which have developed and shaped the rights concerning the parental responsibility are scrutinized.
