Economic and legal functions of trademark

Trademarks are used to ensure commercial transactions and provide protection to both the traders-producers and the consumers. They are of immense importance both from a legal and financial point of view. The main functions of the trademark which are protected by law, are the function of origin, the function of guaranteeing quality, the function of advertising, the functions of information and communication, and the functions of first sale and enhancing competition. These are the legal functions of the trademark. From the economic point of view, the main functions that appeared with the recent case law of the C.J.E.U. are the reduction of market research costs, the incentive provided to producers to improve the quality and price of their products and the so called "brand loyalty" and "premium pricing". Functions are also divided into traditional and modern. The traditional ones include the origin, the quality guarantee, and the advertising function, as they have been recognised for years by the theory and the case law of the courts. The recent case law of the CJEU explicity refers to both the investment function and the information and communication functions, also the function of first sale and enhancing competition. These constitute modern legal functions.
