Summary:
This thesis examines the EU's readmission agreements, using a binary framework to analyse their legal basis, evolution and structure. The first part examines these agreements in the context of the EU's external policies, focusing on their impact and the shift towards greater informality in recent decades. It provides a comprehensive analysis of the significance of readmission agreements for the EU's external policies. The second part looks at readmission agreements as a means for the EU to externalise migration control and addresses the risks and challenges involved. A case study illustrates their impact on the EU legal order. The thesis argues that the EU is using readmission cooperation to externalise migration control, raising fundamental rights concerns and undermining its credibility as a rule of law actor in the international community. The increasing prioritisation of internal security over legal norms is also highlighted.
