Η διεθνής προστασία της πολιτιστικής κληρονομιίας: από τις διακρατικές συγκρούσεις στον θρησκευτικό εξτρεμισμό

`This paper is a description of the international institutional framework, the rules adopted for the protection of cultural heritage in armed conflict situations. The destruction and damage led to the strengthening of international law to deal with these cases, initially within transnational conflicts. Subsequently, these rules were extended to include civil conflict and especially in recent years the rise of religious extremism as a threat to world cultural heritage led to a new declaratory framework of principles. At the same time there was a development of the prohibition of illegal import, export and transfer of ownership of cultural property and the protection is supplemented by humanitarian law and statutes of international criminal courts.
Is there however sufficient protection to cultural goods or are there shortages? What is the relationship between protection regimes? What is the reaction of the United Nations and UNESCO in any type of challenge? Is there room for improvements? In order to answer those questions case studies of destructions and deliberate leveling of monuments in transnational and civil conflicts are reviewed, such as the destruction of the Buddha statues in the valley Bamiyan in Afghanistan from the Taliban regime and the recent attacks of ISIS on the cultural heritage of Iraq and Syria.
