In the international press, in the political and academic discussions, the existence of piracy in Somalia is primarily associated with the absence of the rule. Therefore, the common goal of actors focuses on creating a functioning state in Somalia. However in this study it is argued that piracy in Somalia should not be interpreted only as a symptom of a failed state. This study is divided into two parts.
The first part presents the historical context from ancient times to our days, directly related to the phenomenon of piracy, describes shortly the way the international law governs piracy and presents the current counter-piracy measures.
In the second part, the main focus is on the phenomenon of piracy in Africa and particularly in the Horn of Africa. What is examined, in general terms, is the Western policy under the "failed state" discourse in the West Africa and more specifically in Somalia. Furthermore the causes of Somali piracy are investigated as well as certain characteristics of Somali pirates and their actions. Additionally some data are presented with regard of the costs and profits of the Somali piracy, understanding it as a symptom of a politicoeconomic and social syndrome.
This study and specifically the argumentation in the last part is an attempt to critically exemine, the ideological framework within the measures of counter piracy are constructed . The argumentation of this study, by focusing on the relationship between sea piracy and "weak state" in Somalia, purports to present the process of (re) adjusting political, economical and social measures from a national to a super national level.
