Summary:
The present dissertation analyzes basically two issues. The first concerns the conflict in labour relations between the protection of the employee against the processing of his/her personal data and the free movement of such data. The second relates to the ways of ensuring the protection of the employee in the processing of his/her personal data under L. 2472/1997 and Regulation 2016/679. With regard to the first issue, the conflict between the rights and freedoms of the employer and the employee governs the labour relation as a whole. The processing of personal data is an example of this struggle between the conflicting interests, which are specified on the one hand in the interest of the employer for information on the data of the employee and on the other, in the interest of the employee for information self-determination. The law on the protection of personal data is a system designed to reconcile these interests. Regarding the second issue, it must be said that, following a comparative review of the ways of ensuring the protection of personal data under L. 2472/1997 and Regulation 2016/679, it is not possible to say with certainty which of the two is more protective, because the Regulation has not yet been implemented. In this paper, an assessment is made of whether the latter covers the needs of data subjects, namely employees, given technological developments.
