A study in the procedural aspects of the implementation of Law No. 3869/2010 as it currently stands after legislative amendments in the following Law Nos: 3996/2011, 4161/2013, 4336/2015 and 4346/2015.
Summary:
Law No. 3869/2010 titled “Regulation of debts for over-indebted natural persons and other provisions” establishes the right to civil insolvency in Greece. In order to make the law No. 3869/2010 more effective four legislative amendments have been made to the following laws: 3996/2011, 4161/2013, 4336/2015 and 4346/2015. The procedural framework of the right to civil insolvency is identified in Law No. 3869/2010, in the sixth book of the Code of Civil Procedures, relating where appropriate, proportionally to the bankruptcy code. In this study, procedural issues that arise from the application of Law No. 3869/2010, are analyzed. The issues analyzed are relevant to the subject of the application in the adjudication process and more particularly as follows: the abolition of the compulsory stage of out-of-court settlements, mediation, court jurisdiction, pre-application process, submission of the application, legal entities of applicants, involvement in the trial process of third-parties, temporary judicial protection, termination of legal proceedings, verdict issues and allowable appeals. Furthermore, a number of courts’ decisions interpreting Law No. 3869/2010 are listed along with commentary on the reasoning of law theory and jurisprudence on the procedural issues. Finally, the legislative amendments are evaluated and the scope of improving Law No. 3869/2010 is assessed.
