Summary:
This paper’s subject is about women’s rights in Family Law matters, according to the Justinian Code.
The rights granted to women, under Justinian law, are not confined to family law, as we perceive it today, but they extend to every field of law. This paper is structured in five chapters, which describe woman's position in family, marriage, divorce and emphasis is given to the rights granted to her in matters arising from the property rights of spouses. In particular, it is about the right to claim her dowry and the marriage gifts -in case of a marriage- in order to be able to cope with difficulties and continue living a comfortable life and not suffer poverty because of the divorce.
Special reference is made of certain categories of women, in particular mothers, widows, adulterers and liberals, as special regulations are provided by the law for the protection of her interests. The rights granted to women are derived from the Justinian Code, a collection of Imperial Provisions issued from the time of Emperor Hadrian to Justinian.
In a male-dominated society, where the role of women was limited to household duties and children’s upbringing, the extent of women's requests, in the Justinian Code, addressed to the emperor, in order to seek advice, but the answers received as well, prove the importance of Justinian's legislative work and the increasing entitlements to women, in order to protect her interests and her children.
