The influence of dependence syndrome to the perpetrator's imputability
Summary:
The scope of study in addictions is very broad and constitutes one of the most characteristic subjects of research in both psychiatry and psychology, as well as criminal law. Both the mental health system and the criminal justice system are called upon to deal with the phenomenon of addiction and the criminal behavior that it may have as a consequence.
Through the presentation of psychiatric data on drug addicts and offenders who suffer from alcoholism and their legislative treatment, it is aimed to highlight the need for communication between the two sciences and the contribution of this interaction in the field of criminal law.
More specifically, it is intended to be described the concept of dependence on alcohol and drugs and how it affects the individual's personality in order to be understood its influence on the imputation of the perpetrator. For this reason, reference is made to introductory concepts such as the principle of guilt and freedom of will, which are critical to understanding the association of any mental disorder such as the dependence syndrome with the ability to impute the perpetrator and providing the justification for any appraisal.
