Summary:
This study attempts to approximate the Greek laws, as well as the jurisprudence so far, especially in the recent years, concerning parental responsibility after divorce and separation, and, more particularly, the possibility of a real distribution of its exercise between the two parents, either temporal or functional, in an attempt to establish its joint exercise and thus to achieve a balance in the relations both among the couple,and between the parents and their child. In this context, an overview of the rules of parental responsibility according to our laws in general is to be made, as well as of the specific legislative provisions and jurisprudence of other legal orders, the majority of whom have already proposed joint - shared custody as a rule after divorce.The study also refers to the case of poor exercise of parental responsibility, which may even lead to its removal, and to the case of deduction of custody, which may lead even to partial or total custodyassignment to third parties, especially to a guardian or foster families, highlighting the priorities and principles set by the legislator in this last resort.
