The subjects' right to object to lawful processing of his personal data
Summary:
General reference to the importance of personal data and the law under the umbrella of whom are protected, particularly Greek law 2472/1997 and the GDPR, with reference to the new regulations, provisions and rights provided by GDPR. Analysis of the lawful processing of personal data, in particular an analysis of the principles of processing, consent as a substantive condition of legality and specific reasons for processing. Analysis and content of the subject's right of objection, with reference to the Articles of the Directive 95/46 and article 13 Greek law 2472/97, distinction between absolute and relative objection, content of relative objection and the consequences of exercising the right. Once the notion of legitimate treatment and the right of objection has been understood, the concept of reasoned-reasonable objections is analyzed in the light of the principle of non-abuse of right, the principle of proportionality and the weighting in each case. A number of case-law examples (European Court, Greek courts, personal data protection greek authority) are given to understand reasonable objections. The new framework for exercising the right of objection under the new regulation is mentioned. Analysis of the right to oblivion- the right toerase, as a specific expression of the right of objection and its case-law (European Court, personal data protection greek authority). Issues raised among the right of oblivion and views. Conclusion.
