The abuse of dominant position from a Collective Society of Intellectual Property Rights
Summary:
This thesis attempts to examine the effectiveness of competition rules and in particular, the abuse of a dominant position in respect to Collective Societies of Intellectual Property Rights. The first chapter consists of a brief analysis of the general aspects of intellectual property and collective management in particular, competition laws and namely the abuse of a dominant position as well as the relationship between these two. Subsequently, the second chapter consists of the essential part of this thesis with references to the rules of Article 102 TFEU in relation to collective management. The third chapter, divided into two parts, examines court cases in relation to the abuse of dominant position in community and national case-law. Finally, the last Chapter is focused in the Directive 2014/26/EU and its harmonization by the national law maker in the Greek legal system.
