Summary:
The documents are the most important and trusted evidence, which is in the list of evidence of the article 339 CPC. Sometimes, the one and only document, that the litigant wants to use as evidence in the trial, is in the possess of the other party or a third person. Τhe articles 450 – 452 of CPC provide the disclosure of documents in civil procedure law. This provision has its roots on the action ad exhibendum of roman law. Initially, we examine the legal implement of this claim. Afterwards, there is a comparative analysis between the provision of civil procedure law and the provision of substantive law. Subsequently, there is a theorization of the provision from the perspective of constitutional law, and finally there is a comperative analysis of the national institution with corresponding institution of the federal and common - law.
