Summary:
In the present dissertation the European legal context for the provisional measures is presented and a new European order is introduced, the European order of temporary freezing of bank deposits under the Regulation No 655/2014.
The first part of the dissertation commences with the prerequisites to apply the international provisional measures according to the European Regulations. In addition, the procedure of recognition and enforcement of foreign awards is analyzed.
The second part of the dissertation consists of an explanation concerning the problems arising out of the legal relations between debtors and creditors. These problems are critically discussed in an effort to locate any possible gaps in the law. Furthermore, in that part of the dissertation the steps that the EU followed in order to resolve these problems are displayed.
In the third part of the dissertation the provisions of the European Regulation 655/2014 are explained as well as the requirements for its application so as to render the possibilities it can offer comprehensive to the reader.
Finally, in the last part a comparison is being made between the preexisting possibilities that the creditors already had in their disposition before the Regulation 655/2014 and the new legislation. The aim is to conclude whether the European freezing order of bank accounts constitutes a powerful “weapon” in the hands of the creditors and whether it adequately protects the rights of the debtors.
