Summary:
In order to combat maladministration, it is necessary to set up internal and external control mechanisms in order to ensure both the legitimacy of administrative action and the provision of quality services to citizens in accordance with the principles of transparency and fairness management. Law 3852/2010 with the Constitution of the Ombudsman aims to address the phenomena of maladministration at municipal and regional level and to improve the services provided to citizens and businesses. Ombudsmen are a new form of internal control of Local Authorities whose primary task is to receive complaints of directly affected citizens and businesses for maladministration in the services of the municipality, its legal persons and its businesses, with the competence to mediate in order to solve the related problems. Therefore, it is understood that this is a new form of internal control of Local Authorities, which aims at mediation in order to achieve the observance of legality and the fight against maladministration. The aim of this work is to understand the institutional background and to explore the contribution of this institution to the operation of the municipalities, based on its presence in local communities. The latter is attempted through an approach aimed at analyzing the real contribution of the Constituents, investigating the affairs that have been of concern to them, as well as illustrating the acceptance of the institution on the basis of figures. In particular, the Legislative Framework of the Ombudsman is presented, while interviews were held with Ombudsmen, elected, municipal officials and citizens in order to make any conclusions regarding the functioning and weaknesses of the institution. In addition, an analysis was made of its implementation framework using primary sources such as state laws, ministerial circulars and data from the "DIAVGIA" program, as well as data collection from the annual Ombudsmen’s reports. Finally, through the numerical data of the Ombudsmen operation, with a sample case investigation through the Annual Reports of the Constituents and a statistical case analysis, and after interviews with the above, reference is made to the proposals for revision of the Local Mediation Constitutional Framework, also marking the reactions from the Ombudsmen Network, thus concluding the conclusions and a critical appraisal of its institution and prospects.
