Summary:
The study focuses to the analysis and evaluation of the amendments of Barecon 2017, BIMCO’s industry-standard contract for bareboat charter. Barecon is one of BIMCO’s most successful and widely used charter parties. The new edition of BARECON is slightly leaner than its predecessor and has been adapted to the case-law developments that have occurred in recent years, with additions and modifications that help to clarify and resolve critical legal issues. The study is structured in two parts. The first part deals with the clauses related to the liabilities and rights of the parties, while in the second part reference is made to the basic and optional provisions governing the performance and termination of the contract. The analysis of the above issues is accompanied, where necessary, by references to the decisions of English case-law, which is the determining factor for the revision and modernization of industry-standard contracts.
