Summary:
This dissertation concerns the subject of liability for bunker oil pollution damage and, particularly, its regulation by the -ratified by Greece- International Convention on civil liability for bunker oil pollution damage (Bunkers Convention 2001).
In the first part, the factors that demonstrated the necessity of composition of special legislation are mentioned and the fundamental points of the international convention are analyzed, like its scope of application, its basic definitions and the responsible for the damage persons, focusing on relevant arising issues, such as the dissociation from the previous system of channeling of liability and the preference of its division to more than one persons or the connection between the charterer and Bunkers Convention etc.
In the second part, particular issues concerning the Convention are examined, and, especially, compulsory insurance as part of the Bunkers Convention, and the right of limitation of liability of the responsible persons. The absence of an individual limitation of liability system within the Convention is analyzed, while, at the same time, a comparative approach between Bunkers Convention and other international conventions is attempted, mainly in respect of the Civil Liability Convention (CLC) and the Convention on Limitation of Liability for Maritime Claims (LLMC).
