The Medical Contract
Summary:
Initially, in the present study the meaning of the medical contract is defined, its object is delimited, the contractual parties are also defined and all forms of legal relations between the doctor or the public or private hospital and the patient are exposed. Furthermore, all opinions on legal classification of the medical contract are stated and the basic reflections concerning the legal nature of special forms of the medical contract such as the dental contract or the contract, which has as an object the surgeries without a therapeutic purpose, are presented. Moreover, a wide part of the present study is dedicated to the content of the medical contract and the principal and ancillary obligations of the doctor and the main contractual obligation of the patient, which is his obligation to pay the medical fee, are extensively mentioned. Reference is also made to the civil liability of the doctor after the conclusion of the medical contract and (to) the ways of the dissolution of this contract. Finally, in the last part of the present study a presentation is made on the provisions of the German Civil Code concerning the medical contract as well as a critical approach to them.
