Summary:
In the modern rule of law, constitutionalism is multi-tiered and dynamic, especially with regard to the state governance of common objectives, democratic social needs and supra-legality of human rights. The collaborative and guaranteed public interest for all the above, is enlightened and governed by the regulatory provisions and the normative standards of sustainable development. Legal claims for the protection of the environment in conjunction with the legal conditions of financial initiative accumulate acquired rights (droits acquis), demarcated freedoms and institutional guarantees that interact in favor of their coordinated sustainability. In all these synergies, the “consolidating legal- productive bridge” of the principal of proportionality, founded on the safety and effectiveness of the law, transcends weighted conflicts or mitigating compromises and puts forward, systematically and with the aim to optimize, legal convergences towards the unified and common holistic objective, as the major functional criterion within the suggested methodology of the principle of “harmonized integration”, claiming legal rationale and consistent justification of the regulatory estimations of the Decision issued by the competent Public Administration and Court of Justice, far from arbitrary and pointless “out-of-law” activisms. The positive impetus to the sustainability of Environmental Security and Euphoria, with Social Benefit and Productively Balanced Economic Prosperity, ultimately contributes to the Sustainability of the State itself. The lucidity of the legal rationale and the regulatory clarity of legal principles have the potential to lead to regenerate the overall organizational position and functional interaction of public law in relation to reality. The aim pursued is an essentially democratic and technocratic governance imposed by contemporary challenges, based on the support of an equally social and liberal rule of law, between the “preventive protectionism” and the “upgrading right-ism”. Besides, the pressure exerted by reality itself imposes a coordinated management of public objectives as common needs, in a more solidary and transparent way than ever before, so that the State may move from the “law of expediency” to the «expediency of the law», and that the Rule (“the State”) of Law may claim a Fairer State.
