Summary:
The present dissertation entitled "The admissibility of the opposition based on article 933 of the code of civil procedure, as well as its grounds", clearly focuses on the issues arising from the conditions of admissibility of the Opposition based on Article 933 of the code of civil procedure against Εnforcement. This opposition is a reaction to a series of previous acts of Enforcement. In this dissertation is analyzed the special legal nature of the legal aid of the opposition based on article 933 of the code of civil prosedure, as well as the object of the trial that is opened with. It focuses on the conditions of the admissibility of the opposition, such as the legalization, both in assets and liabilities, the establishment of the legitimate interest, the jurisdiction of the court in which the opposition is proceeded and deals with the resulting dispute, but also the procedural framework of the act of the opposition. Furthermore, the grounds of the opposition and the admissibility of their application are examined, as well as the additional grounds. Moreover, a few pages of this dissertation are dedicated analyzing the deadline of the opposition' s apply, according to the Article 934 of the code of civil procedure. In the last pages, it is investigated whether it is possible to claim for damages, in case of "unjust" execution, by applying directly the lawsuit of the article 914 of the Civil Code, bypassing the article 940 (3) of the code of civil procedure.
