Summary:
The phenomenon of international child abduction, in the form of their illegal movement
from the country of their usual residence or their detention by one of their parents, usually the one who does not take care of their person, is a reality that in recent decades has take on large dimensions.Through the provisions of the Hague Convention of 1980 (in Greece it has been ratified by law 2102/1992) and Regulation 2201/2003 (Brussels IIa) but also of the New Regulation 1111/2019, with a period of application on 1 August 2022 , is intended, on the one hand, to protect the child upon his / her immediate return to his or her place of habitual residence and, on the other hand, to ensure respect for his / her right of custody, which exists under the law of a Contracting State from the rest.
Parameters of the civil aspects of international child abduction, which are regulated by the above legal texts, are the illegal movement and detention of the child, his parental care with the individual manifestation of the right of custody, communication, the concept of normal residence of the child, the process of his return and the exceptions provided for in the Hague Convention and the Rules of Procedure, the right to be heard and the best interests of the child, as a dominant concept at the core of international and European texts aimed at safeguarding the rights of the child.
