Summary:
Despite the considerable momentum it has developed and the scientific interest it has attracted over the last decade, the concept of national constitutional identity is a relatively new concept of European law. Thus, in this context, the main aim of this PHD, which forms part of the scientific subject of European constitutional law, is to clarify the meaning of the concept of national constitutional identity of Article 4(2) of the TEU, its scope and its functions in the European legal order. Article 4 par. 2 TEU is applied by the Court of Justice of the European Union in cases concerning linguistic and cultural diversity, fundamental rights and regional governance. Finally, the concept of national constitutional identity contributes to the strengthening of a common European constitutional culture and to the promotion of a community of constitutional traditions.
