Legal consequences of judicial decisions in Civil and Administrative Procedural law
Summary:
This thesis deals with legal consequences of judicial decisions both in civil and in administrative procedural law and consists of comparative remarks between these two sections of procedural law, concerning res judicata, formative force and enforceability. The main points are res judicata and formative force. The thesis insists on the differences between civil and administrative procedural law, in order to find out the reasons that creates them. These differences are numerous concerning formative force. However, the most significant similarities between these two procedures are also analytically presented.
The meaning and the function of res judicata are examined, as well. What are analyzed in detail are the circumstances under which res judicata determine future judgments, due to the legislation of both procedural fields. Moreover, this essay examines the basic points regarding the force of the judgment altering a legal relation of civil law. In the field of administrative procedural law, the study mentions the most important matters regarding the content of formative decisions and the judgments’ retroactive effect, usually erga omnes.
Τhe essay is structured by mentioning legal consequences of judicial decisions according to civil procedure at first, and focusing on the respective matters of administrative procedural law in the second part. In the end, the conclusions of the research are summarized.
