Summary:
Euthanasia, as well as other forms of medically assisted premature termination of life, such as assisted suicide, is a topic continuously debated in many Western societies. This is based on the prolongation of human life in these areas, as well as their secularization and liberalization. The issue of euthanasia is complex as it involves social, legal and moral factors. In this project, special emphasis is placed on the legal part.
In the first chapter definitions of the different forms of euthanasia are provided. Further discussion takes about the reasons that lead patients to request such a treatment. In the same chapter, arguments for and against euthanasia are presented and discussed.
In the second chapter, euthanasia is approached from its moral, social and religious aspect. In the case of the moral approach, the discussion focuses on whether euthanasia is in line with the principles of Hippocrates and beneficence, while a comparison is made between euthanasia and palliative care. At the social level, various societies are compared in terms of their acceptance of euthanasia, considering also the reasons that explain their stance. Finally, there is a discussion about the stance of religion to the topic of euthanasia, while the factor of secularization and its effects are also examined.
The third chapter can be considered as the main focus of this project, as it examines the legal framework of the countries that have introduced euthanasia and assisted suicide. Along with that examination takes place of the legal framework of countries that have to some extent legalized assisted suicide, as well as countries in which both of these acts are illegal. In the same section, domestic and international court cases on the issue of euthanasia are presented and the decisions that have been finally held. The third chapter also discusses the issue of advance directives / living wills and their legal effects, as well as the legal liabilities of doctors in the cases of euthanasia.
In the fourth chapter, an examination takes place about the legal framework of euthanasia and assisted suicide in Greece, both at criminal and constitutional level. Finally, the fifth chapter is the project’s epilogue.
