Summary:
This project is about the now constitutionally protected and exclusive jurisdiction of the National Council for Radio and Television during the process of licensing of radio and television stations in contrast to other agencies of the executive or legislative branches. In this context, this paper analyzes the 15th article of the Greek Constitution, as revised in 2001, as well as relative case law by the Council of the State. According to it, the National Council’s for Radio and Television exclusive competence includes the entirety of the process that will lead up to the issuing of the requested license, while at the same time demanding the cooperation between the National Council for Radio and Television and other instruments of the executive and legislative branches. In addition, the State’s obligation to finding ways to achieve an agreement between the different political parties is stressed out, in order for the members that constitute the National Council of Radio and Television to be elected and to lawfully license the radio and television stations.
