The Ethics of Restricting Human Rights when interacting with Non-Human Beings. An attempt for a first philosophical foundation
Summary:
Refusing to accept human behavior towards non-human animals (ΝΗΑ), we first briefly present how they are treated by major religions. We conclude that those based on the Abrahamic tradition (Judaism-Christianity-Islam), consider man as the pinnacle of creation, a position that allows him to subjugate and exploit them. The most important of the prevailing moral theories are then examined (Aretological ethics, Deontological ethics, Utilitarianism, Singer’s Preference Utilitarianism, Regan’s Theory of animal Rights, Francione’s Abolitionism). A variety of problems and intrinsic inconsistencies, are revealed and discussed. However, theories that use the concept of “right” appear as more promising. After having considered this concept, we demonstrate that if NHA are granted rights, these are self-abolished with the act of total liberation. Examining the alternative option, that NHA can be part of the moral community even if they do not possess any rights at all, we discover that there cannot exist any unilateral human duties towards them. Faced with such a situation, it is attempted the foundation of a new moral theory that can justify the a priori restriction of their liberties when humans interact with NHA. To this end, the basic requirement of any first moral principle is initially established. As a specialization and immediate application of the proven requirement, we propose and analyze the first principle of “Restriction Ethics” which requires that any incentive with reference to a human motive-intention-action complex, has to be compatible with transferring part of the power of the strong to the weak. As a means of testing the efficacy of the newly established theory, the examination of dilemmas and problems that were first encountered during the presentation of the prevailing moral theories are revisited and re-evaluated. As an outcome, plausible and consistent results are now derived.
