Summary:
The introduction defines the scope of the work. In particular, the object of this is the evaluative antinomies in the criminal protection of the physical integrity of humans and animals. To this end, the criminal provisions that protect the legal good of human and animal health and life are reviewed. This specific process is necessary in order to produce findings, which will then enable a comparative overview of the relevant provisions.
In the second chapter of the paper, the legal good of health and physical integrity of man is analyzed. In this context, the criminal provisions that protect the above legal goods are reviewed and the relevant criminal sanctions provided for are codified.
In the third chapter of the work, the legal good of the health and physical integrity of companion animals is analyzed. In this context, the criminal provisions that protect the above legal goods are reviewed and the relevant criminal sanctions provided for are codified. In particular, a historical overview takes place regarding the transition from the old to the new law, in order to make possible findings regarding the treatment of related offenses at the level of criminal sanctions by the legislator.
In the fourth chapter, the penal provisions that protect the health and physical integrity of humans and animals are comparatively reviewed. From this process, evaluative contradictions are established between the distinction between human and animal from a criminal point of view. Evaluative antinomies usually consist of the heavier disrespect historically brought by criminal insults at the expense of human health and physical integrity compared to that at the expense of companion animals.
In the final chapter of the paper, a full assessment of the current law takes place and prospective improvements to the current criminal legislation governing animal abuse are considered. In particular, it is pointed out that the evaluative antinomy regarding the physical integrity of man and animal still exists under the current sanctioning system, but it has been largely restored in relation to the previous ones. criminal provisions that protected animals. Given, however, the concept of the equality of man and animals, as has already been supported by philosophers who dealt with the specific issue, there is room for improvement in the relevant criminal provisions. The improvement of these provisions consists in the adoption by the legislator of the model of human and animal equality and in the consequent equalization of the criminal sanctions that provide for attacks on the physical integrity and health of animals with those of humans
