Summary:
The doctoral thesis concerns the social protection of the child in the greek legal framework, as it has been enshrined, specifically through the guarantee of his social rights and the relevant state obligations, in the light of human rights development and the rule of law.In the first part of the thesis, “child” is presented as a subject of rights and obligations. Specifically, the legislation regarding the Child’s Rights and relevant administrative actions is analyzed. At first, the international legal framework is examined and specifically the Convention on the Rights of the Child (OHCHR) and the European Convention on the Exercise of Children's Rights, followed by the provisions of the Treaty of Lisbon, hence, the legal framework of the European Union regarding the protection of the child was enacted as well as the provisions of the Charter of Fundamental Rights.The framework of child law is complemented by the provisions of the Greek Constitution and the fundamental laws on the reform of child offenders, child labour and welfare. The rights of the child are analysed as human rights, their importance and the obligations of the State, the impact on family and society are emphasised. Moreover, the scope of family and State is analysed based on case law of the European Courts and the State obligations are determined, through the lens of the fundamental principle of the best interest of the child. In the second part, the mechanism of state protection is analysed, which focuses on the welfare, health, and education and whether or not the State authorities act sufficiently regarding their obligations. At first, the instruments which undertake the implementation of the protective measures are defined. Afterwards the system of social welfare towards the children by the government institutions, legal entities of public and private law, the private institutions is evaluated. Specifically, the implementation of the National health care system on children and the educational system, school health and education on health is reviewed. Moreover, the actions for the confrontation of the current problems, such as bullying at schools, drugs and alcohol are examined. Finally, the implementation of the State mechanism on the provision of Social Services to vulnerable children’s groups, like refugees, Roma, immigrants, children in danger is specifically taken under consideration. At the end of every chapter a critical evaluation follows, while in the epilogue the findings of the research are briefly summarized.
